Terms of Service

Fixon Technology Inc. ("Fixon," "we," "us," or "our"), headquartered in Canada, operates the Platform, which includes our websites, mobile applications, and related services offering zero-code website building, event organization, service appointments, group buying, and other features powered by our proprietary reservation engine.

These Terms of Service ("Terms") form a legally binding agreement between you and Fixon. By accessing or using the Platform, you agree to these Terms. If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization.

If you do not agree to these Terms, do not use the Platform.

1. Eligibility and Account

1.1 Eligibility

You must be at least 18 years old to use the Platform. Additional requirements may apply to specific features (e.g., set by event organizers).

1.2 Account Creation and Security

  • You must provide accurate information when registering.
  • You are responsible for maintaining the confidentiality of your password and for all activities under your account.
  • Notify us immediately at help@fixon.ai if you suspect unauthorized access.

1.3 Modification, Suspension, or Termination

We may modify, suspend, or terminate your account or access if you violate these Terms, for community protection, or due to inactivity. We will notify you where possible. Organizers may also control access to their groups or events.

2. Your Content and Conduct

2.1 Your Content

You retain ownership of content you post ("Your Content"). By posting, you grant Fixon a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, modify, distribute, and display Your Content to operate, improve, and promote the Platform.

Your Content must comply with these Terms, our Usage and Content Policies, Payment Policies, and Trademark Guidelines.

2.2 Prohibited Conduct

You agree not to:

  • Post illegal, harmful, or infringing content.
  • Violate laws or third-party rights.
  • Interfere with the Platform's operation.
  • Use automated means to access the Platform without permission.

We may remove content or terminate accounts for violations.

3. Platform Use and License

We grant you a limited, non-exclusive, revocable, non-transferable license to use the Platform for personal or organizational purposes, subject to these Terms.

The Platform is provided "as is." We do not guarantee uninterrupted availability and may modify or discontinue features.

4. Fees and Payments

4.1 Fees Charged by Fixon

Certain features require payment. Fees are in USD (or local currency where specified) and may include taxes. Subscriptions auto-renew unless canceled.

We may change fees with notice.

4.2 Fees Charged by Organizers

Organizers may charge for events, memberships, or services. Payments are processed via third-party providers (e.g., PayPal).

Refunds are governed by our Payment Policies and applicable laws.

4.3 Cancellation and Refunds (EU/UK Residents)

EU/UK users may cancel paid subscriptions within 14 days for a full refund (subject to usage). Contact help@fixon.ai.

5. Intellectual Property

Fixon owns all rights to the Platform, including software, trademarks, and content (excluding Your Content). You may not copy, modify, or reverse-engineer the Platform.

Report alleged infringements to help@fixon.ai.

6. Third-Party Services

The Platform may integrate third-party services (e.g., payment processors). Your use is subject to their terms.

7. Disclaimer of Warranties

The Platform is provided "as is" without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose, to the fullest extent permitted by law.

8. Limitation of Liability

To the maximum extent permitted by law, Fixon shall not be liable for indirect, incidental, consequential, or punitive damages. Our total liability shall not exceed the amounts paid by you in the 12 months prior to the claim.

Certain jurisdictions do not allow limitations, so these may not apply to you.

9. Indemnification

You agree to indemnify and hold Fixon harmless from claims arising from your use of the Platform, Your Content, or violation of these Terms.

10. Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of Canada (excluding conflict of laws principles), except where prohibited.

10.2 Arbitration (Non-EU Users)

For users outside the EU/UK, disputes shall be resolved by binding arbitration in Canada on an individual basis. You waive rights to class actions and jury trials.

10.3 EU/UK Users

EU/UK users may pursue claims in their local courts or use alternative dispute resolution.

11. Changes to Terms

We may update these Terms. Material changes will be notified via email or prominent notice. Continued use constitutes acceptance.

12. General Provisions

  • Severability: Invalid provisions do not affect others.
  • No Waiver: Failure to enforce does not waive rights.
  • Assignment: We may assign these Terms; you may not without consent.
  • Entire Agreement: These Terms (with incorporated policies) constitute the full agreement.
